The big idea for conservatives aiming to repeal the health overhaul is amending the Constitution to allow states the power to do so. This way, Obama would be out of the loop because presidents have no role in the amending process.

The proposal is designed to give states the power to repeal any legislation if two-thirds of their legislatures agree. Enacting the amendment would require three fourths of the state legislatures.

Dubbed the “Repeal Amendment,” this cause will be quite the rallying point for conservatives in campaigns even if it does not end up scrapping the President’s health overhaul.

The proposed amendment:

“Any provision of a law or regulation of the United States may be repealed by the several states, and such repeal shall be effective when the legislatures of two-thirds of the several states approve resolutions for this purpose that particularly describe the same provision or provisions of law or regulation to be repealed.” (repealamendment.org)

    I know this isn’t very nice but…I hope every member of the tea party has their insurance canceled or their insurance refuses to cover their child’s illness or they are bankrupted by medical bills.
    Alternatively I would like to see the employment breakdown of the tea party members are they all employees of insurance companies?

    This would effect such a sea change in our government that I’m struggling with noodling whether such an amendment could even be constitutional. Can a constitutional amendment be unconstitutional? It would essentially delegate to the states a second level of veto power. This really strikes me as a nutty proposed amendment, but my problem with it is that I can actually envision it happening.

    Since we have had Amendments supplanted by later amendments and one totally repealed, I would think that that would be the way to alter rather than it being possible for the Supreme Court to declare it “unconstitutional”. The court can do that to a state, but I don’t think they could do it to Congress.

    The silver lining is that there is no way that either house could muster 2/3 to support anything that has any hint of controversy -- and this certainly has that hint of controversy, so it would be left to the states to call for a CC to propose this, and I don’t see that happening.

    Bethy, it’s unclear to me how well your older nephew is communicating/understanding thoughts that are being communicated to him. I understand that the paralysis is fading--wonderful! And that family is ready to attach him to the Telluride lift. Sounds like a reasonable goal for March.
    I suggest obtaining the services of thirtyish neurologist from a respected group practice. The medical pros in the family can steer him and his wife in the right direction. Competence and competence and competence are what are needed at this point--every other attribute must fall by the wayside.
    My parting instruction to my doc was that I did not want to wake up without control of my limbs, etc.. And that my advanced directive addressed those points and that copies of that document plus the appropriate powers of attorney were there as well. These wishes were also discussed with Stinky and Toots.
    These surgeons are like fighter pilots. In my discussion with my lead guy, I basically said that I chose him because of his reputation and because I liked him and his staff. And that I believed him when he said that he understood that I was letting him fix and fly my airplane and that I was trusting him to land it safely. He expressed understanding of the special level of dependence that Stinky has on me--that she depends on my departing after she leaves the party.

    but then I haven’t heard much first-hand, so maybe the problem is too many people trying to communicate. I count on my bil to keep his eyes on things. He has been able to see all the mri’s and ct’s etc after the fact
    and I fully trust him.
    Today patient ate oatmeal, yougrt, etc, and obviously the headache is gone -- exit pain meds. He dressed and went to ot and pt. He said it didn’t hurt and wasn’t hard and could/should have been harder. He tried to get out of bed and fell -- his reasoning is that it’s like skiing, you fall when you are learning. He was very alert and sharp, and I’m so relieved cuz I know that strokes can cause depression. I don’t think he’s had much more return of sensation, and am not sure he’ll ski in March. My goal for him is to walk first. Thanks for listening to all my angst -- I had a lot more hysteria when I was here alone.
    Flatus, I agree with you re the way to handle things, and I’m sure that’s what they’re doing. We are all so watchful and questioning and will keep our eyes on my nephew to make sure he’s coming along. Your comments re your doc sound like mine, and would have been for him if it hadn’t been such an emergency.
    As it is, Alta Bates Hospital is a certified stroke unit, and he’s now in a rehab hospital -- every one in dis unit is a stroke patient.
    Faltus, You’re on my prayer “list” too, and so is Patsi. However, I missed the post where Patsi’s health problem was explained. Anybody care to fill me in?
