    Fund VII. Gawker today posted some Bain documents today showing that Bain, like many other PE firms, had engaged in this practice of converting management fees into capital gain. Unlike carried interest, which is unseemly but perfectly legal, Bain’s management fee conversions are not legal. If challenged in court, Bain would lose. The Bain partners, in my opinion, misreported their income if they reported these converted fees as capital gain instead of ordinary income.

    The events of 2007/08 were a perfect storm for Obama and his team.

    Even if he had been extremely capable in his first term, he would not be able to replicate the momentum of his 08 campaign.

    He was absolutely in the right place at the right time.That confluence seldom comes along more than once, for anybody, but especially for a politician.

    In 2008 voters voted enthusiastically for Obama.
    Now he is having to ask them to give him the benefit of the doubt, that’s a pretty tough sell on the best of days.

    I’m going to give him the benefit of the doubt, not because of what he has done, but because of what republicans have done.

    They have time and time again put defeating Obama and regaining power ahead of the welfare of the country. Polling indicates that there may be a large number of people who agree on that point. It may be enough to get him over the top. At this point however I am not feeling all that confident.

    TURLEY: Well, there’s a misconception about Barack Obama as a former constitutional law professor. First of all, there are plenty of professors who are “legal relativists.” They tend to view legal principles as relative to whatever they’re trying to achieve. I would certainly put President Obama in the relativist category. Ironically, he shares that distinction with George W. Bush. They both tended to view the law as a means to a particular end — as opposed to the end itself. That’s the fundamental distinction among law professors. Law professors like Obama tend to view the law as one means to an end, and others, like myself, tend to view it as the end itself.

    Truth be known President Obama has never been particularly driven by principle. Right after his election, I wrote a column in a few days warning people that even though I voted for Obama, he was not what people were describing him to be. I saw him in the Senate. I saw him in Chicago.

    CUSACK: Yeah, so did I.

    TURLEY: He was never motivated that much by principle. What he’s motivated by are programs. And to that extent, I like his programs more than Bush’s programs, but Bush and Obama are very much alike when it comes to principles. They simply do not fight for the abstract principles and view them as something quite relative to what they’re trying to accomplish. Thus privacy yields to immunity for telecommunications companies and due process yields to tribunals for terrorism suspects.

    Yes I did see that reference, what year was that in, wasn’t Romney long gone by then? If that is the problem that seems to me to be more of a Bain problem than a Romney problem. But the obvious question is why hasn’t the IRS step in?

    Not that it isn’t a question of is it legal the question is it fair. Is that your position? What makes it fair and legal, is the tax code. What is fair? Me and my partner living in a high expensive city, or you and yours living on a parcel of land that somehow became tax exempt because of…well really who knows why. That’s just an example, have no idea where you live or what you live in . Nothing is fair, winners and losers. To tell you the truth I would be in favor of no deductions of any kind for anyone or thing, in place of a lower tax rate for everyone and thing. Seriously why should a person who is paying on a mortgagee get to deduct the interest off their tax returns, and if is their primary home and they live in it for over 2 years and sell it is all tax free money. The poor person living in an apartment isn’t able to get those types of benefits? Why is that? Tax code. Can’t wait to sell our home as we will be moving straight into an apartment. The American dream may not be home ownership.

    I actually agree with you about the tax code being as simple as possible except that I do think it should still be graduated to some extent simply because it is cheaper to be rich. Certainly the mortgage deduction should be on principal residence only and some states actually do give renters a percentage of their rent for property tax collected from the owner on state taxes. No reason that couldn’t be done on national level if building owners get a credit on their interest.

    It should be as simple as possible and none of this pass through business. Income is income whatever the source. some could be indexed or adjusted, but if it is money made on money then tax it.

    I wish I had read Jonathan Turley’s article when it came out. Then I would have had 6 days on my realization known that Obama was going to screw everyone.

    But it does not really matter, there is no way that I can vote for Romney. If I do, I will need to be checked into a mental institution.

    ST. PETERSBURG — Gov. Rick Scott has announced he will pull out of his Republican National Convention activities, including his speech scheduled for Monday night in Tampa.

    Scott said his focus is on being the governor of Florida and he needed to focus on Tropical Storm Isaac’s advance on the state. He added that the state is closely monitoring the storm as it moves near the Florida Keys and into the Gulf of Mexico.

    You guys keep yakking about strippers, but the repub conventioneers aren’t bringing them any business. You have them confused with the mainspringmedia guys, lobbyists -- like Bill’s friend morris, and congress critters.

    The actual ripper conventioneers are more interested in bowel relief than genital relief. They’re sitting in the johns and janes of their hotel rooms, staring dazedly at the towel racks, & wondering if they’ll ever be able to crap again.

    A Jigger of Metamucil
    A Jigger of Mylanta
    A Jigger of Milk of Magnesia

    Pour the Milk of Magnesia into a frosted champagne flute. Using a the back of a spoon to prevent splashing, carefully pour a layer of Metamucil on top. Next, repeat the procedure carefully pouring the layer of Mylanta on top. Decorative shavings of Ex-Lax on top.

    Place the filled champagne flut in the freezer for 5 minutes to render the drink gelid.
